Terms of Service

1. Acceptance of Terms

These Terms are an agreement between you and Weganar Consulting LLC, doing business as weganar.com (“Weganar”, “we”, “us”). By accessing and using Weganar (the “Service”), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Weganar provides location and property intelligence for US addresses. The service allows users to:

• Convert addresses to geographic coordinates (geocoding) and standardize address formats
• Retrieve property context such as parcel identifiers and census geography
• Purchase and download bulk parcel data (GeoPackage and vector tiles)
• Generate credit-based reports. The reports offered are: Demographic report, Hazard report, School report, Property intelligence report, Neighborhood score, Environmental report, Demographic trend report, Severe-weather history report, Broadband availability report, Crime & safety report. Current names, prices, and descriptions are published on the pricing page.
• Access these capabilities through RESTful API endpoints, a Model Context Protocol (MCP) server that authenticates with the same API keys, and a web dashboard for managing keys, credits, and purchases

3. User Accounts

An account is required to obtain API keys, buy credits or parcel data, run billed reports, and use the MCP server. The public demonstration on the homepage does not require an account. To create or sign in to an account, you must:

• Sign in through Google or GitHub and keep that provider account secure — it is the only way into your Weganar account
• Maintain the security of your account credentials
• Be responsible for all activities under your account

4. Service Tiers and Usage Limits

Paid monthly plans are billed in advance through Stripe and renew automatically until cancelled. You may manage payment methods, invoices, and cancellation through the billing portal. Cancellation normally takes effect at the end of the current paid period. Contact support about billing corrections or refund requests. Taxes may be added where applicable. In addition to monthly plans, Weganar offers prepaid credits and one-time purchases. New accounts receive 150 free starter credits on first sign-in; credits do not expire and can be topped up in credit packs. Credit-based reports deduct credits per successful report at the rates shown at checkout. In the authenticated web dashboard, a successful report is saved for 90 days; its HTML and PDF formats are renderings of the same saved result and are not charged separately. Choosing Refresh data runs the report again using current sources and deducts the then-current report price. REST API and MCP report calls remain separate billed requests. Bulk parcel-data products are one-time purchases licensed per county, per state, or nationally. One-time credit and parcel purchases are processed through Stripe and, being consumable or delivered digital goods, are generally non-refundable except as required by law or at our discretion.

5. Acceptable Use Policy

You agree not to:

• Exceed your tier's rate limits or attempt to circumvent them
• Use the service for illegal or unauthorized purposes
• Attempt to gain unauthorized access to our systems
• Resell or redistribute our data — geocoding results, parcel data, or report output — beyond the license granted with your purchase
• Use the service to spam or send unsolicited communications
• Interfere with or disrupt the service or servers

6. API Keys and Security

You are responsible for:

• Keeping your API keys secure and confidential
• Not sharing API keys with unauthorized parties
• Immediately notifying us of any suspected key compromise
• Using API keys only for authorized applications

7. Your Geocoding Results

“Geocoding Results” means what the geocoding endpoints return for an address you submit: the standardized address, coordinates, Census geography (including block, tract, and county FIPS), the parcel identifier where available, and the accompanying match and provenance metadata.

Subject to Section 5, we grant you a perpetual, worldwide, non-exclusive, royalty-free license to store, copy, index, modify, and use Geocoding Results within your own products, systems, and analyses, including in derivative datasets you create. There is no caching period and no obligation to delete or re-request a result. This license survives termination: results you obtained while your account was active remain yours to keep and use.

Report output may likewise be retained and used indefinitely within your own products and analyses. Bulk parcel-data products are licensed separately — per county, per state, or nationally — as described in Section 4, and those license terms govern that data.

This section grants the license that Section 5 refers to. It does not permit reselling or redistributing the data as a standalone dataset, or using it to offer a competing geocoding or property-data service.

8. Data Usage and Privacy

Our data usage and privacy practices are governed by our Privacy Policy. By using this service, you also agree to our Privacy Policy, which is incorporated by reference into these Terms.

9. Service Availability

While we strive for high availability, we do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Temporarily suspend service for emergency maintenance
• Implement rate limiting to ensure fair usage

10. Disclaimer of Warranties

The service, and all geocoding results, parcel data, and report output, are provided “as is” and “as available”, without warranty of any kind, express or implied. To the maximum extent permitted by law we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Our results are derived from public and third-party sources — federal, state, and county records, and licensed third-party data. We do not warrant that any result is accurate, complete, current, or fit for a particular decision. Each result carries match and provenance metadata precisely so that you can evaluate it before relying on it, and that evaluation is yours to make.

Reports are informational. They are not consumer reports as defined by the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), and you may not use them, in whole or in part, as a factor in establishing eligibility for credit, insurance, employment, housing or tenancy, or for any other purpose covered by that Act. Hazard output is not a flood determination, and no report is a substitute for a professional survey, inspection, appraisal, or title search.

11. Limitation of Liability

To the maximum extent permitted by law, Weganar Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Our cumulative liability for all claims arising out of or related to these Terms or the service shall not exceed the greater of (a) US$100 or (b) the aggregate amount of fees actually paid by you to us during the twelve (12) months prior to the assertion of such claim. This limit applies regardless of the form of action — whether in contract, tort (including negligence), strict liability, or otherwise — and applies even if a remedy is found to have failed of its essential purpose.

12. Termination

We may terminate or suspend your account at any time for violation of these terms. You may request account termination at any time by contacting us.

Unspent credits. Credits are tied to your account and have no cash value. They do not expire while your account is open. If you ask us to close your account, we will tell you the remaining balance and give you 30 days to spend it before the account is deleted; anything left after that lapses. If we terminate your account for a material breach of these Terms, any remaining balance is forfeited. In neither case are credits refundable, consistent with Section 4.

Subscriptions and purchases. Closing your account cancels any active subscription; we cancel the subscription before the account is deleted, and will not delete an account while a subscription is still active. Bulk parcel-data products you have already downloaded remain licensed to you on the terms of that purchase, which closing your account does not revoke.

What survives. Section 5 (Acceptable Use) and Section 7 (Your Geocoding Results) survive termination: geocoding results you obtained while your account was active remain yours to store and use, subject to the limits in Section 5. Sections 10 (Disclaimer of Warranties) and 11 (Limitation of Liability) also survive.

13. Changes to Terms

We reserve the right to modify these terms at any time. The date at the top of this page is the current version. Material changes will be shown in the dashboard until you next sign in, which records that version on your account. We may also email the address on your account. Continued use of the Service after a material change has been published — including through the API or MCP server — constitutes acceptance of the new terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, USA, without regard to its conflict-of-law provisions. The service is operated by Weganar Consulting LLC. Any dispute arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts located in the State of Nevada, USA.
